Facing the impending rationing in health care and consequently necessary priorisation, this article pleads for primarily following the capability approach of justice. The decent minimum of just health care is orientated to the capability of leading a personally responsible life, functioning in its respective society. The capability approach is on the one hand semantically justified by considering different ideas of humankind; on the other hand, its capability of application is structurally checked by a network of further criteria concerning justice.
