The article describes the ongoing debates about a "right to development" (RTD) in the context of the UN anti its sub-organizations, reconstructs the origins of the RTD since 1948/ 1966, and discusses the main inherent problems of the concept of RTD, i.e. the specific legal status and the indecisiveness of this norm as well as the ambiguity and lack of clarity of the concepts of development. Although the RTD is not a clear-cut legal norm, it should be understood as a normative moral concept, which can and should be transformed into specific legal norms on different levels in the respective legal orders in various states and in the contexts of international law. The complexity of die RTD-concept indicates the overlapping border area of morality und legality - in some extent RTD is a complex of moral norms, partly of legal norms as the result of ongoing processes of legislation. This tension between the moral anti the legal point of view is shortly exemplified by a discussion of the entitlement to freedom of elementary poverty (Pogge) and the personal as well institutional accountability thereof.
