Because of the progressive secularisation and pluralisation of society and as a result of the unification process of the European Union, questions of church state law and religious constitutional law are becoming relevant once more. In determining the relationship between church and state, the "Böckenförde-Diktum" has long been cited. However, the analysis shows that Böckenförde's formulation poses considerable problems. Future ethical, theological and judicial reflections on religious constitutional law should respect the transformed socio-cultural frame work and view individual basic rights, particularly the basic right of religious freedom, as a normative core.
