Each criminal law depends on certain anthropological convictions. However the reason and meaning of penalty in the secular state, and in a pluralistic society are confronted with the problem that one cannot presuppose a uniform idea of man and society, in which all members of the society will agree. Against this background die paper discusses die anthropological and theological implications of "absolute", "relative", and "constructive" theories of penalty as well as concepts of "restorative justice", and of victim offender mediation.
