The question of the scope of advanced directives has been a crucial issue during
the debate on the new German law on advanced directives in 2009. Yet in retrospect it shows that this was a problematic restriction of the debate. The far more complex ethical issues concern questions of how to interpret an advanced directive and of how to apply it to a present situation. This paper explores the communicative structures of autonomy and the temporal structure of advanced ethical judgments and applies them in these ethical issues. The author argues for relating the advanced directive to the presumed present will of a patient.
